Law Summary

EU REACH is a comprehensive chemical regulation framework. It requires companies to register chemical substances they produce or import, evaluate risks, and manage them. It also allows for authorization of specific uses and the restriction or banning of hazardous substances to protect human health and the environment. 

Law Obligation

  • Manufacturers and importers must register substances they produce and import with the European Chemical Agency (ECHA). This involves providing detailed information on the properties, uses, and safe handling of these substances.   
  • Companies must maintain detailed records of the chemicals used in their products and supply chains. This transparency helps in tracking and managing chemical usage, ensuring compliance with REACH regulations.    
  • Substances of Very High Concern (SVHCs) must be identified and managed appropriately during manufacturing.   
  • Brands and retailers need to stay updated on the latest REACH restrictions and ensure they do not use banned substances. If a product contains SVHCs above the required limit, manufacturers and retailers must inform REACH and consumers about the presence of these substances and provide instructions for recall.
