Law Summary

This proposed EU law aims to combat greenwashing by requiring explicit environmental claims made to consumers to be clear, accurate, based on scientific evidence, and verified by an accredited third party before use. It also seeks to regulate the proliferation and transparency of environmental labels.

Law Obligation

  • For substantiation of explicit environmental claims, conduct an assessment specifying claim scope  
  • Assess claims using recognised scientific evidence and international standards and demonstrate the significance of the claim from a life-cycle perspective. 
  • Comparative claims must ensure that data for comparison is equivalent and cover the same value chain stages and environmental aspects. 
  • Environmental labels must be transparent, with clear ownership and objectives. 
  • Verification and certification are required to ensure claims and labelling schemes comply with the directive. Verification should be conducted by a qualified verifier and the certificate should be recognised by competent authorities.s.
