Law Summary

Implementing France’s Anti-Waste for a Circular Economy (AGEC) law, this decree mandates detailed consumer information for products like textiles and packaging. Requirements cover recyclability, recycled content, hazardous substances, manufacturing traceability (for textiles), and microplastic release risk, applied progressively based on company size.

Law Obligation

  1. Only bags eligible for joint collection and recovery with household bio-waste are deemed “compostable.” 
  2. Article R.541-223 of the Decree forbids claims such as biodegradable, environmentally friendly, or other similar claims, on any product/ packaging intended for consumers. Effective since 1 May, 2022, this Article applies to all companies regardless of turnover or the number of units placed in the French market annually.  
  3. To use the term ‘recyclable’, conditions like over 50% recycled material by mass, along with availability and efficiency of the French recycling facilities must be met 
  4. Disclose countries involved in the last 3 production steps. 
  5. Provide data on hazardous substances (refer to Annex 1 of the law).
  6. Digital display of environmental details for products at the point of purchase, ensuring accessibility for 2 years. Use a QR code on a website or the government-recognised Clear Fashion app.
