Law Summary

Under the UK Environment Act 2021, this regulation will prohibit large businesses (£50m+ turnover) from using key forest-risk commodities (initially non-dairy cattle products, cocoa, palm, soy) produced on illegally used land. It requires annual due diligence reporting. Specific implementation details via secondary legislation are still pending government action.

Law Obligation

Palm oil, cocoa, soy and non-dairy cattle products (beef and leather). Dairy products will be separately in scope where they are derived from animals fed on a diet that contains a forest risk commodity, such as soya or palm kernel expeller.

Co-products – such as palm kernel expeller, palm fatty acid distillate (PFAD), soya hulls etc – are also in scope.

Businesses in scope must submit an annual compliance report that the products in and their derivatives (e.g. co-products) – have been produced in accordance with local laws.
