Law Summary
This Directive requires EU employers to implement pay transparency measures. Key rules include providing salary information pre-employment, employee rights to request pay data, gender pay gap reporting (for firms >100 employees), and joint pay assessments if significant unexplained gaps exist. Member states must implement by June 2026.
Law Obligation
Comparator: employers must identify a “comparator” of the opposite sex who performs work of equal value and whose pay level is higher, to justify any pay differences. Support for workers: Member States must ensure that workers have access to support and advice on their rights, including legal aid, and that trade unions and other organisations can support workers in exercising their rights. Right to information: all employees have the right to request information from their employer about their pay levels.
