Law Summary

This is a self-regulatory code from the Australian Association of National Advertisers guiding responsible environmental claims in advertising. It stresses truthfulness, substantiation, clarity about sustainability benefits, and avoiding the exploitation of consumer environmental concerns, complementing legal obligations under the ACL.

Law Obligation

  • Claims must not mislead or deceive. Disclaimers or important limitations and qualifications should be prominently displayed clearly and specific language. 
  • Representation of environmental benefits or limitations should be clear and understandable in relation to a specific aspect of a product or service. 
  • Claims must be relevant, specific, and clearly explain the significance of the claim. 
  • Claims must not overstate the environmental benefits expressly or by implication. 
  • Claims should be able to be substantiated and verifiable. Claims should meet applicable standards related to the claimed benefit or advantage. Testimonials must reflect the genuine, informed, and current opinion of the person giving the testimonial.
